Terms of Service
Thanks for using ARC Staffing Solutions! Whether you’re looking for your next job, working an Assignment, or looking for great people to join your team, we’re glad you’re here. We wrote these Terms of Service to be as clear and straightforward as possible. Questions or concerns? Reach us anytime at privacy@kkrstaffing.com or 800-233-1332.
These Terms apply whenever you visit or use https://arcstaffingsolutions.com and related sites, pages, forms, and job boards (the “Website”), and ARC Shift, our time and attendance system at https://shift.kkrstaffing.com and in the ARC Shift mobile app. They work together with our Privacy Policy, any notices or policies we post, and any other binding document you sign with us (together, the “Terms” or the “Agreement”).
These Terms are a binding agreement between you and KKR Staffing LLC DBA ARC Staffing Solutions, an Ohio limited liability company (“ARC,” “Company,” “we,” “us,” “our”). They apply whether you are a job seeker or worker (“Candidate”), a business that hires through us (“Client”), or simply a visitor (together, “you”).
By accessing or using the Website or our Services, you agree to these Terms. If you don’t agree, please don’t use the Website or Services.
We may update these Terms from time to time. Changes take effect 10 days after we post them. If you keep using the Website or Services after that, you accept the updated Terms. When these Terms change, ARC Shift asks you to review and acknowledge the new version the next time you sign in.

Your use of the Services
Here’s what we offer, and how you should use it.
ARC Staffing Solutions connects great people with great work across Ohio, Kentucky, and West Virginia. Our Services include:
- Job search and applications: browse open positions in light industrial, clerical, and manufacturing roles, and apply online.
- Candidate profiles: create and manage your profile, resume, availability, and work preferences.
- Placement and Assignments: temporary, temp-to-hire, and direct-hire opportunities with our Clients.
- Time keeping with ARC Shift: punch in and out, and see your hours.
- Onboarding and payroll tools: complete new-hire paperwork, view schedules, and access pay information through our partner platforms.
- Client workforce solutions: request staff, manage orders, approve time, and receive reporting.
You must use the Website and Services in full compliance with these Terms, our posted policies, and all applicable federal, state, and local laws.
We may change, suspend, or discontinue any part of the Website or Services, temporarily or permanently, with or without notice. We won’t be liable to you or anyone else for doing so.
Some Services are provided through third-party platforms (for example, payroll, background screening, or e-signature providers). Your use of those platforms may also be governed by their own terms and privacy policies.
Your Account
Pretty basic, but necessary before using some of our Services.
To have an Account, you must be at least 18 years old, or at least 16 where the law allows you to do the job, or a legally registered business. If you act for a business, you confirm you have authority to bind that business to these Terms.
All information you give us must be accurate, current, and complete. Please keep it up to date.
ARC Shift accounts are created only by invitation from ARC. You sign in with a one-time code sent to your email or mobile phone; ARC staff and Client approvers also use an authenticator app.
Security matters, and we need your help. You are responsible for all activity under your Account. Never share a sign-in code, your password (where one is used), or your authenticator app with anyone, and don’t let anyone else use your Account. Tell us right away at privacy@kkrstaffing.com or 800-233-1332 if you suspect someone else has used it.
For job seekers and workers
We want to help you find work. Here’s how it works.
No guarantee of placement. Submitting an application or creating a profile does not guarantee an interview, an Assignment, a certain number of hours, or a certain pay rate. Job postings may change or be filled at any time.
Truthful information. Everything you submit, including your resume, work history, certifications, references, and time records, must be true and complete. Providing false or misleading information may result in removal from consideration, the end of an Assignment, or other action allowed by law.
Employment relationship. When you accept an Assignment, your employment terms are set by the offer, onboarding documents, and policies you receive at that time, not by these Terms. Unless a written agreement says otherwise, employment with ARC is at-will, meaning either you or ARC may end it at any time, with or without cause or notice, as permitted by law.
Screening and background checks. Some positions require background checks, drug screens, E-Verify, or other pre-employment screening. We will only conduct these with any notice, disclosure, and authorization required by law, including the Fair Credit Reporting Act. Those disclosures are provided separately.
Equal opportunity. ARC Staffing Solutions is an Equal Opportunity Employer. We do not discriminate based on race, color, religion, sex, pregnancy, sexual orientation, gender identity, national origin, age, disability, genetic information, military or veteran status, or any other status protected by law. If you need a reasonable accommodation to apply, to work, or to use ARC Shift, contact your ARC branch, call 800-233-1332, or email privacy@kkrstaffing.com.
Time keeping with ARC Shift
Accurate time means accurate pay.
You’ll be paid for all the time you work. Record your time accurately: punch in when you start work, out when you stop, and for breaks and meal periods as your Assignment requires. Don’t work “off the clock.” If you forget a punch or a time looks wrong, tell your supervisor or your ARC branch as soon as you can so it can be corrected.
Punch only for yourself. Never punch in or out for someone else, or ask anyone to punch for you. Never enter a time you know is wrong.
Corrections and approvals. Authorized ARC staff and Client approvers may correct and approve time records. Every correction keeps the original punch, who made the change, when, and why. ARC staff and Client approvers must make corrections only to fix real errors, and never to reduce time actually worked.
Location. Some worksites require the ARC Shift mobile app to confirm you are at the worksite when you punch. The app checks your location only at the moment you punch, after you allow it on your device. See our Privacy Policy.
Pay. Hours in ARC Shift are used to pay you through payroll. Your pay, deductions, and pay stubs are governed by your employment documents and the law.
For Clients
Thanks for trusting us with your workforce!
Staffing services for Clients are governed by a separate Client Agreement, which covers bill rates, payment terms, conversion and direct-hire fees, worksite safety, supervision, insurance, and liability. If these Terms and a Client Agreement conflict, the Client Agreement controls.
Clients who approve time in ARC Shift agree to review it in good faith and on time, to approve all time actually worked, and to raise disputes with ARC rather than reduce a worker’s recorded time.
Requesting staff through the Website, by phone, or by email is a request only. It is not a binding commitment until confirmed by ARC.
Clients agree not to use the Services to solicit, recruit, or hire ARC Candidates outside of the process and fees described in their Client Agreement.
Calls, texts, and emails
We’ll reach out about work, so here’s how we stay in touch.
By giving us your phone number or email address, you agree that ARC and its service providers may contact you by phone call, text message (SMS/MMS), and email about job opportunities, Assignments, schedules, onboarding, timekeeping, payroll, and your Account. Some calls and texts may be sent using automated technology.
Consent to receive marketing texts is not a condition of employment or of using our Services. Message frequency varies. Message and data rates may apply.
You can opt out of texts anytime by replying STOP, and get help by replying HELP. You can unsubscribe from marketing emails using the link in any email. Opting out of some messages may limit our ability to tell you about available work.
ARC Shift sign-in codes by text
What they are. When you ask to sign in to ARC Shift with your mobile number, we text you a one-time six-digit code. We send one text each time you ask for a code, and no other messages from this program.
Cost. Message and data rates may apply, according to your mobile plan.
Help. Reply HELP to any code text, call 800-233-1332, or email privacy@kkrstaffing.com.
Stopping. Reply STOP to stop these texts. You will then need to sign in another way; your ARC branch can help.
Delivery. Mobile carriers are not liable for delayed or undelivered messages.
Your mobile number and consent are never shared with or sold to anyone for marketing. See our Privacy Policy.
Your Content
Wondering what we do with what you submit?
You are responsible for the Content you submit, including your resume, application, documents, and messages. You confirm you have the right to share it, and that it is accurate, lawful, and doesn’t infringe anyone’s rights.
You own your Content. We will not sell it. By submitting Content, you give us a non-exclusive, royalty-free license to use, store, copy, and share it as needed to provide the Services. For example, we may share your resume and qualifications with Clients when considering you for an Assignment, as described in our Privacy Policy.
We may remove any Content at any time, at our discretion.
Acceptable use
When using the Services, you agree not to:
- Submit false information or impersonate anyone else
- Punch in or out for anyone else, or enter time you know is wrong
- Share your sign-in codes or let anyone else use your Account
- Apply on behalf of someone else without their permission
- Post anything unlawful, harassing, discriminatory, or threatening
- Scrape, copy, or harvest job postings, time records, or other users’ information
- Upload viruses or malicious code, or try to gain unauthorized access to our systems
- Get around the location check, bot check, or other security features
- Interfere with the normal operation or security of the Services
- Use the Services for any purpose other than seeking work, recording and approving time, or obtaining staffing services
Fees
Using the Services to search and apply for jobs and to record your time is always free for Candidates. ARC will never charge you a fee to apply for or be placed in a job. Client fees are set out in the applicable Client Agreement.
Termination
Don’t go! But if you do, here’s what happens.
You may close your Account at any time by contacting us at privacy@kkrstaffing.com.
We may suspend or terminate your Account or access to the Services at any time, with or without cause or notice.
Closing your Account does not end an active employment relationship or Assignment; that is handled under your employment documents. We keep certain records, such as applications, I-9s, time, payroll, and tax records, as required by law or under our standard record-retention practices.
Confidentiality
What’s confidential, stays confidential.
Candidates may be exposed to confidential information about Clients, their worksites, processes, or customers. You agree to keep that information confidential and use it only to perform your Assignment, both during and after your Assignment. ARC staff and Client approvers who can see other people’s information in ARC Shift may use it only for their work and must keep it confidential. Clients’ other confidentiality obligations are set out in their Client Agreement.
Intellectual property
Let’s give credit where it’s due.
We own all rights to the Website and our Services, including our name, logo, design, text, graphics, and software. You may not copy, modify, republish, or use our materials without our written permission. All rights not expressly granted are reserved.
If you send us feedback or suggestions, we may use them freely without any obligation to you.
Privacy
Your privacy matters to us. We collect, use, and protect your personal information as described in our Privacy Policy.
Disclaimer of warranties
There are some promises we can’t make.
The Website and Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We don’t guarantee that the Services will be uninterrupted, secure, or error-free, or that job postings, pay rates, or other information are always accurate or current. If ARC Shift is unavailable, tell your supervisor or ARC branch so your time can be recorded another way.
Limitation of liability
Our worst-case scenario.
To the fullest extent permitted by law, ARC and its owners, officers, employees, agents, and partners (“Related Parties”) will not be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, data, or opportunities, arising from your use of the Website or Services.
Our total liability to you for any claim relating to the Website or Services will not exceed $100. This limit does not apply to wages you have earned, to liability that cannot be limited by law, or to obligations under an employment relationship or Client Agreement, which are governed by those documents.
Indemnity
Your worst-case scenario.
You agree to defend, indemnify, and hold harmless ARC and its Related Parties from any claims, losses, and expenses, including reasonable attorney’s fees, arising from your misuse of the Services, your Content, or your violation of these Terms or applicable law. This does not apply to any claim for wages owed to you.
Miscellaneous
Almost done! These legal terms are important too.
Governing law and disputes. These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law rules. We’ll each first try in good faith to resolve any dispute informally. If we can’t, any lawsuit must be brought exclusively in the state or federal courts located in Greene County, Ohio.
Assignment. We may transfer our rights and obligations under these Terms to an affiliate or successor without your consent. You may not transfer yours without our written consent.
Severability. If any part of these Terms is found unenforceable, it will be removed and the rest will remain in effect.
No waiver. Our failure to enforce any part of these Terms is not a waiver of our right to enforce it later.
Entire agreement. These Terms, our Privacy Policy, and any signed agreement with us are the entire agreement between us regarding the Website and Services.
Order of precedence. If documents conflict, this order controls: (1) a signed Client Agreement or employment agreement; (2) other signed documents; (3) these Terms; (4) other posted policies.
Survival. Sections that by nature should survive termination, including confidentiality, intellectual property, disclaimers, limitation of liability, indemnity, and governing law, will survive.
Electronic signatures. You agree that electronic signatures, records, and acknowledgments, including acknowledging these Terms in ARC Shift, have the same effect as handwritten ones.
